Terms of Service

These terms are the agreement between you and Hertis. We've kept them as plain as we can — please read them before using the Service.

Hertis ("Hertis", "we", "us") is operated by Aadyash Technologies Private Limited, India. By creating an account or using the Hertis app or website (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use Hertis

You must be at least 18 years old to create a Hertis account. By using the Service you confirm that you can enter into this agreement and that the information you provide is accurate. You are responsible for keeping your account secure and for the activity that happens under it.

2. Your family circle and content

Hertis lets you and the people you invite share photos, videos, voice notes, stories and messages within a private family "circle". You own the content you create. By sharing it through Hertis, you grant us a limited licence to store, process, and display it solely to operate the Service for you and your circle — for example, to deliver a moment to your family, back it up, and compose it into your yearly film or a keepsake.

You agree to share only content you have the right to share, and to use Hertis respectfully. You must not use the Service to upload unlawful, harmful, or infringing content, to harass anyone, or to attempt to access another family's circle.

3. Subscriptions and payments

Hertis is free to start. Some features require a paid Family plan, and certain one-time items (such as a Legacy Guarantee or a gift) may be purchased.
The parent is never charged. Only the family member who chooses to pay is billed.
Purchases are made and billed through the Apple App Store or Google Play, and are subject to their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the period.
You manage or cancel a subscription through your App Store or Google Play account settings. Except where required by law or the app store's policies, payments are non-refundable.

4. Not a medical or emergency service

Hertis is a connection and memory-keeping app — not a medical, emergency, caregiving, or safety-monitoring service. Its gentle "presence" and peace-of-mind signals are for warmth only and must never be relied on to check on someone's health or safety, or in any emergency. In an emergency, always contact your local emergency services or a medical professional.

5. Availability and changes

We work to keep Hertis running reliably, but we provide the Service "as is" and cannot guarantee it will always be available, uninterrupted, or error-free. We may add, change, or remove features over time. If we make significant changes to these terms, we'll update the date above and, where appropriate, notify you in the app.

6. Ending your use

You may stop using Hertis and delete your account at any time from within the app. We may suspend or end access to the Service if these terms are seriously or repeatedly broken, or where required by law. Our commitment to never needlessly delete a family's shared memories is described in the app and our Privacy Policy.

7. Disclaimers and liability

To the fullest extent permitted by law, Hertis and Aadyash Technologies Private Limited are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the Service. Nothing in these terms limits any liability that cannot be limited under applicable law.

8. Governing law

These terms are governed by the laws of India, and the courts of India will have jurisdiction, except where the law of your country of residence requires otherwise.
